Overview and Acceptance of Terms
These Terms of Service (the “Terms”) constitute a legally binding agreement between you and Forme Pilates Inc. (“Forme”, “we”, “us”, or “our”) governing your access to and use of our website, studio facilities, services, products, and any related offerings (collectively, the “Services”).
By accessing our website, creating an account, purchasing services, or attending classes, you acknowledge that you have read, understood, and agree to be bound by these Terms, including our Liability Waiver and Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.
We reserve the right to modify or update these Terms at any time in accordance with applicable laws. Your continued use of the Services following any such changes constitutes your acceptance of the revised Terms.
Eligibility and Use of Services
In order to use our Services, you must have reached the age of majority in the Province of New Brunswick or have obtained the consent of a parent or legal guardian.
By using our Services, you represent and warrant that all information provided to us is accurate, complete, and current, and that you will use the Services only for lawful purposes and in compliance with all applicable laws and regulations. We reserve the right to refuse service or access to the Services at our sole discretion, where permitted by law.
Account Registration and Security
Certain Services require you to create a personal account. When creating an account, you agree to provide accurate and complete information and to keep such information up to date.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other
breach of security. Forme Pilates Inc. shall not be liable for any loss or damage arising from your failure to safeguard your account information.
Purchases, Memberships, and Gift Cards
Forme Pilates Inc. offers memberships, class packs, single classes, and retail products for purchase. All prices are listed in Canadian dollars and are subject to change without notice.
Payment is required at the time of purchase. All purchases are final and non-refundable, except as required under applicable consumer protection laws in New Brunswick. Memberships and class packs are subject to specified expiration dates, which are disclosed at the time of purchase, and unused classes are non-transferable.
Gift cards may be purchased without creating an account and do not expire. However, any services purchased using a gift card will remain subject to the standard expiration terms applicable to those services.
Bookings, Cancellations, and No-Show Policy
All classes must be booked in advance through our website or designated booking platform.
Clients may cancel a reservation up to four (4) hours prior to the scheduled class start time. Cancellations made within this window, or failure to attend a booked class, may result in the forfeiture of the class credit and/or the application of a cancellation fee.
Clients who arrive late may be denied entry to the class in order to preserve the safety and experience of other participants. In such cases, the class will be treated as attended for billing purposes.
Studio Policies
To ensure a safe and respectful environment for all clients, participants are expected to arrive at least ten to fifteen minutes prior to the scheduled class time.
Grip socks are required for all reformer classes and strongly encouraged for other classes. We reserve the right to refuse participation or entry to any individual whose conduct or condition may pose a safety risk or disrupt the experience of others.
Health and Safety Requirements
By participating in any class or service offered by Forme Pilates Inc., you confirm that you are physically capable of engaging in such activities and that you have consulted a qualified healthcare provider where appropriate.
You acknowledge that participation in fitness activities involves inherent risks, including the risk of injury, and you voluntarily assume all such risks.
Reformer Equipment Safety
Certain services, including reformer-based classes, are subject to equipment safety limitations. By booking or participating in these classes, you confirm that you meet the physical requirements necessary for safe participation and that your body weight does not exceed 300 pounds, which reflects
manufacturer-recommended safety limits.
Forme Pilates Inc. reserves the right to restrict participation in any class where it reasonably determines that doing so is necessary to ensure the safety of the client or others.
Liability Waiver and Assumption of Risk
Participation in any Services requires acceptance of our Liability Waiver and Release.
By attending classes or using our Services, you acknowledge and agree that you voluntarily assume all risks associated with participation in physical activity and the use of studio facilities. You further agree to release and discharge Forme Pilates Inc., its owners, employees, and representatives from any and all claims, liabilities, or demands arising from injury, loss, or damage, except where such liability cannot be excluded under applicable law.
Website Use and Intellectual Property
All content made available through our website, including but not limited to text, images, branding, logos, and class formats, is the property of Forme Pilates Inc. or its licensors and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable right to access and use the website for personal, non-commercial purposes only. Any unauthorized reproduction, distribution, or use of such content is strictly prohibited.
Acceptable Use and Security
You agree not to engage in any activity that may compromise the security or functionality of the website or Services. This includes, without limitation, attempting to gain unauthorized access to systems, introducing malicious software, or transmitting unlawful or harmful content.
We reserve the right to investigate any suspected violations and to take appropriate action, including cooperating with law enforcement authorities where necessary.
Third-Party Services and Links
Our Services may incorporate or provide access to third-party platforms and services, including payment processors and e-commerce providers.
Forme Pilates Inc. does not control and is not responsible for the content, policies, or practices of such third parties. Your use of third-party services is at your own risk, and we encourage you to review their terms and policies.
Payments and Billing
All payments are processed through third-party payment providers. By making a purchase, you agree to provide accurate and complete billing information and to promptly update such information as necessary.
We reserve the right to refuse or cancel any order and to limit quantities of Services offered, where permitted by law.
No Warranties
The Services are provided on an “as is” and “as available” basis, without any representations or warranties of any kind, whether express or implied, except as required by law.
We do not warrant that the Services will be uninterrupted, error-free, or that any defects will be corrected.
Limitation of Liability
To the fullest extent permitted by applicable law, Forme Pilates Inc. shall not be liable for any indirect, incidental, special, or consequential damages, including but
not limited to loss of data, revenue, or business opportunities, arising out of or related to the use of our Services.
Indemnification
To the fullest extent permitted by applicable laws of New Brunswick, you agree to indemnify, defend, and hold harmless Forme Pilates Inc., its owners, directors, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of or related to your use of the Services, your breach of these Terms, or your violation of any applicable law or third-party rights.
Privacy
Your submission of personal information is governed by our Privacy Policy. We encourage you to review this policy to understand how your information is collected, used, and protected.
Termination
We reserve the right to suspend or terminate your access to the Services at any time, without notice, where you have violated these Terms or where we reasonably believe such action is necessary.
All obligations and liabilities incurred prior to termination shall survive the termination of this agreement.
Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of New Brunswick and the applicable laws of Canada.
